PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of CERTIORARIFIED MANDAMUS to call for the records pertaining to the impugned order of the Respondent No.1 dated 23.01.2025 and quash the same as illegal and direct the Respondent No.1 to issue Passport to the petitioner by considering his application in File No.MD1077284196525 dated 07.01.2025 within time stipulated by this Court. 1/5

ORDER
The present writ petition has been filed seeking to quash the communication issued by the first respondent wherein the petitioner has been called upon to offer his explanation for the adverse police report.
2. The learned Government Advocate(crl.side) appearing for the 2nd and 3rd respondents brought to the notice of the Court that the petitioner has been implicated in 4 criminal cases. Out of which 2 of them have been disposed of in favour of the writ petitioner. As on today, the petitioner is involved in criminal case in Cr.No.75 of 2014 on the file of the second respondent which has culminated in filing of a charge sheet in S.C.No.57 of 2018 on the file of Special Court for SC/ST(PoA), Act 1987. The petitioner has also been involved in another criminal case in Cr.No.229 of 2022 on the file of the second respondent which has culminated in filing of a charge sheet in S.T.C.No.1365 of 2022 on the file of the learned Judicial Magistrate No.I, Sivagangai. 2/5
3. In view of the above said facts, the petitioner is directed to approach the trial Court in S.C.No.57 of 2018 and S.T.C.No.1365 of 2022 to seek permission of respective Courts to go abroad. In case if any such application is filed before the said Courts, the same shall be disposed of within a period of 4(four) weeks. Based upon the orders to be passed by the respective trial Courts, the first respondent is directed to proceed in accordance with law.
4. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 03.02.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/5
