ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to direct the second respondent not to harass the petitioner and his family members by considering the petitioner's representation dated 19.01.2023.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondents.

3. The learned Government Advocate (Criminal Side) appearing for the respondents would submit that previously FIR came to be registered against the petitioner in Crime No.334 of 2021 dated 13.06.2021 under the provisions of the NDPS Act and in that case, he was already arrested and subsequently released on bail and that the second respondent, after completing the investigation, has filed the final report and now the case is pending before the jurisdictional Court. 2/4

4. The learned counsel appearing for the petitioner would submit that the police came to the house of the petitioner and directed him to appear before them without issuing any summons.

5. The learned Government Advocate (Criminal Side) appearing for the respondents would submit that they have not initiated 107 Cr.P.C. proceedings so far and that they have decided not to take any coercive steps against the petitioner. He would further submit that the petitioner has given a representation (not to harass) dated 19.01.2023 to the first respondent and the same is pending.

6. In view of the above, the first respondent is directed to consider the representation of the petitioner dated 19.01.2023 and pass orders in accordance with law.

7. With the above direction, this Criminal Original Petition stands disposed of.
