ORDER

The petitioner has come forward with this petition seeking for a direction, directing the second respondent to complete the investigation and file a final report(Charge sheet) in Crime No.363 of 2012 before the learned Judical Magistrate Court, Sivagiri within the time frame fixed by this Court.

2. The learned counsel for the petitioner would submit that on the basis of the complaint given by the petitioner, a case in Crime No.363 of 2012 has been registered for the alleged offences under Sections 409 IPC against the accused, but the second respondent has not shown any interest to investigate the case and to file a final report and hence, the petitioner has come forward with this petition for the above stated relief.

At this juncture, the learned Government Advocate (Criminal Side), on instructions, would submit that on the basis of the complaint given by the petitioner, a case has been registered and investigation is going on and he would further submit that he wants three months time to complete the investigation and to file the final report.

4. Considering the rival submissions made on either side, the second respondent Police is directed to complete the investigation in Crime No.363 of 2012 and to file a final report before the Jurisdictional Court within a period of three months from the date of receipt of a copy of this order.

5. The Criminal Original Petition is disposed of with the above direction.
