PRAYER : Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus direct the Respondent No.3 to give the adequate police protection for harvesting paddy planted in the properties bearing Survey No.9/9 for an extent of 79 2/3 cents and Survey No.15/1 for an extent of 95 cents and survey No.9/2 for an extent of 35 cents situated at Kudikaadu Village Avudaiyarkovil Taluk, Pudukkottai District on the basis of petitioner's representation dated 06.01.2025. ORDER

This Writ Petition has been filed to direct the Respondent No.3 to give the adequate police protection for harvesting paddy planted in the properties bearing Survey No.9/9 for an extent of 79 2/3 cents and Survey No.15/1 for an extent of 95 cents and survey No.9/2 for an extent of 35 cents situated at Kudikaadu Village Avudaiyarkovil Taluk, Pudukkottai District on the basis of petitioner's representation dated 06.01.2025.

2. Mr.A.Thiruvadi Kumar, learned Additional Public Prosecutor takes notice for the respondents. By consent, this writ petition 2/5

is taken up for final disposal at the admission stage itself.

3. I have considered the submission of the learned counsel appearing for the writ petitioner and the learned Additional Public Prosecutor appearing for the respondents.

4. On instructions, learned Additional Public Prosecutor submitted that based on the complaint given by the private respondents, enquiry is pending in CSR No.37 of 2025, on the file of respondent police. However, he would concede that only the petitioner has cultivated in the said land. Hence, the respondent police will consider the representation of the petitioner to give police protection for harvesting the paddy cultivated in the subject property.

5. In view of the aforesaid submission, it is seen that the petitioner has only cultivated in the subject land. Due to the dispute between the parties, if delay is caused in harvesting, it will cause irreparable loss and hardship to the petitioner and also to the crops, which were cultivated. Hence, the 3rd respondent is directed to give 3/5

adequate police protection for harvesting the paddy cultivated in the subject properties situated at Kudikaadu Village, Avudaiyarkovil Taluk, Pudukkottai District by considering the petitioner's representation, dated 06.01.2025.

6.With the above directions, this Writ Petition stands disposed of. No Costs.
