PRAYER: This Criminal Original Petition is filed under Section 482 Cr.P.C., to direct the learned Additional Mahila Court, Madurai (Magisterial Level) to conduct the trial and dispose of the case in C.C.No.478 of 2014 within the time frame fixed by the Court. O R D E R

The petitioner has come forward with this petition seeking for a direction to the Additional Mahila Court, Madurai (Magisterial Level) to conduct the trial and dispose of the case in C.C.No.478 of 2014 within the time frame fixed by the Court.

2. The learned counsel for the petitioner submitted that on the basis of the complaint given by the petitioner, a case in Crime No.25 of 2013 has been registered on 05.12.2013 for an offence under Section 4 of Tamil Nadu Prohibition of Women Harassment Act and after due investigation, charge sheet has been filed which was taken as C.C.No.478 of 2014. Now, it is pending before the Additional Mahila Court, Madurai (Magisterial Level), but in-turn all the accused are absent before the Court and filed an application under Section 317 Cr.P.C., they are not yet received the charge sheet and other documents. On perusal of the Bdiary, it shows that some of the accused were absent for some days and with a view to drag on the proceedings, the accused has following the same tactics, who in turn, they are absent before the Court and filed an application under Section 317 of Cr.P.C.,

3. Heard the learned Government Advocate (Crl.side).

4. Considering the same, this Court is of the view that it is a fit case for giving direction to the Additional Mahila Court, Madurai (Magisterial level), to dispose of the case in C.C.No.478 of 2014 within a period of six months from the date of receipt of a copy of this order, after giving opportunity to both parties.

5. The Criminal Original Petition is disposed of with the above direction.
