O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second and third respondents to modify the patta in Patta No.3413 in respect of Survey No.108/3A1A, situated at Pooseri Village, Mudukulathur Taluk, Ramanathapuram District and consequently to direct the third respondent to issue a separate patta in respect of the said Survey No.108/3A1A, by considering the petitioner's representation dated 02.01.2026, within a time frame to be stipulated by this Court. 2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the fourth and fifth respondents, as no adverse orders are proposed to be passed against them.

The grievance of the petitioner is that the subject property originally belonged to the petitioner's grandfather, who executed a Settlement Deed dated 17.09.1994 in favour of the petitioner and his maternal aunt, namely, Deva Kirubai, when they were minors, appointing the petitioner's mother as their guardian. After the petitioner attained majority and approached the authorities for issuance of patta, he came to know that the property documents stood in the names of the fourth and fifth respondents, claiming that they had obtained a relinquishment deed from the petitioner's mother during the petitioner's minority. However, the petitioner's mother had no locus standi to execute any such relinquishment deed, in view of the terms of the Settlement Deed executed by the petitioner's grandfather. Based on the said relinquishment deed, the fourth and fifth respondents obtained patta in their favour. Therefore, the petitioner submitted a representation dated 02.01.2026 seeking Page No. 3 of 6

modification of the patta and issuance of patta in his name. Since the same has not been considered, the petitioner has filed the present Writ Petition.

4. The learned Government Advocate appearing for the first to third respondents, on instructions, would submit that the petitioner's representation dated 02.01.2026 would be considered and appropriate orders would be passed by the second respondent within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 02.01.2026 and pass appropriate orders on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The representation dated 02.01.2026 shall be disposed of after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity of hearing to the petitioner, the private respondents i.e., fourth and fifth respondents and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at Page No. 4 of 6

liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
