This Writ Petition is filed seeking a Mandamus as against the respondent to accept the resignation of petitioner and record the name of Mr.Sangilinathan as hereditary trustee of Arulmighu Shivasubramania Swamy Thirukoil, Sivanthipatti, Srivilliputhur Taluk, Virudhunagar District, by passing orders on the application of the petitioner dated 13.01.2026 under section 54 (1) of HR and CE Act.
2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The learned counsel for the petitioner submitted that the petitioner is the hereditary trustee of Arulmighu Shivasubramania Swamy Thirukoil, Sivanthipatti, Srivilliputhur Taluk, Virudhunagar District. Due to age ailment, he is unable to effectively administer the temple. Hence, the petitioner made a representation on 13.01.2026, seeking to accept the resignation of petitioner and record the name of Mr.Sangilinathan as hereditary trustee of Arulmighu Shivasubramania Swamy Thirukoil, Sivanthipatti, Srivilliputhur Taluk, Virudhunagar District, under section 2/4
54 (1) of HR and CE Act. Since the said representation has not been considered till date, the petitioner has filed this Writ Petition.
4. The learned Special Government Pleader appearing for the respondent would submit that the representation of the petitioner dated 13.01.2026 would be considered in accordance with law.
5. In view of the same, without expressing any opinion on the merits of the matter, this Court directs the respondent to consider and pass orders on the representation of the petitioner dated 13.01.2026 on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
