Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences under Section 294(b), 323, 506(ii) of IPC, in Cr.No.34 of 2019 on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that the first petitioner is the wife of the defacto complainant. A2 is her sister's husband and after her sister's death, she had illegal intimacy with A2. When the same was questioned by the defacto complainant, A1 along with A2 attacked the defacto complainant, thereby he sustained injury and admitted in the hospital. Hence, the complaint. 3.The learned counsel appearing for the petitioners would submit that the petitioners are innocent persons and they did not commit any offence as alleged by the prosecution. The defacto complainant always suspected the fidelity of the first petitioner and filed this false case.

State would submit that investigation is still pending. 5.Considering the fact and circumstances of the case and the gravity of offence, this Court is not inclined to grant anticipatory bail to the petitioners.

6.Accordingly, this criminal original petition stands dismissed.
