and consequently, direct the third respondent to restore S.No.159/12B (now S.No. 159/12B2) in the petitioner's father's name as per the order of the second respondent passed in M.C.P.No: /137 (7249)/2025/A3 dated 28.08.2025 within a time stipulated by this Court.

ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the third respondent to cancel the patta bearing Patta No.2168 in respect of S.No.159/12B2, situated at Poongudaiyar Village, Cheran Mahadevi Taluk, Tirunelveli District, in accordance with the order passed by the second respondent in Ni.M.C.P.No:/137(7249)/2025/AA3, dated 28.08.2025, and consequently, direct the third respondent to restore S.No.159/12B (now S.No.159/12B2) in the name of the petitioner's father, as per the said order of the second respondent, within a time frame to be stipulated by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the respondents 4 and 5, notice to the respondents 4 and 5 is hereby dispensed with.

The learned counsel appearing for the petitioner would submit that the patta bearing Patta No.2168 in respect of S.No.159/12B2, Poongudaiyar Village, Cheran Mahadevi Taluk, Tirunelveli District, has been erroneously recorded and is required to be cancelled. The second respondent, by order in Ni.M.C.P.No:/137 (7249)/2025/AA3, dated 28.08.2025, has directed that the property in S.No. 159/12B (now S.No.159/12B2) be restored in the name of the petitioner's father. It is further submitted that the third respondent has not yet complied with the directions contained in the said order, resulting in prejudice to the petitioner. Hence, the present Writ Petition.

5. The learned Special Government Pleader appearing for the respondents 1 to 3 would submit that the third respondent will consider the case of the petitioner on merits and pass appropriate orders in accordance with law, within a time frame to be fixed by this Court.

Recording the above submissions, and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner's case on merits and pass appropriate orders in accordance with law, taking into account the order passed by the second respondent, dated 28.08.2025. The third respondent shall afford a reasonable opportunity of hearing to the petitioner, the respondents 4 and 5, and any other persons who may be affected by such decision, and pass orders within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
