Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of certiorarified mandamus to call for the records pertaining to Impugned Refusal Check Slip in Refusal Number RFL/Vilagudi/53/2025 dated 19.08.2025 passed by the Respondent and quash the same as illegal and consequently direct the Respondent to register the Petitioner's Sale Deed dated 19.08.2025 in accordance with law within a stipulated period as framed by this Court.

ORDER

This Writ Petition has been filed challenging the impugned refusal check slip in Refusal Number.RFL/Vilagudi/53/2025 dated 19.08.2025 issued by the respondent and to direct the respondent to register the petitioner's sale deed dated 19.08.2025 in accordance with law. 1/5

2. The learned counsel appearing for the petitioner would submit that the subject property was originally purchased by one K.Padmanabhan by virtue of public auction vide sale deed dated 08.12.2008. Thereafter, one A.Ragupathy obtained general power of attorney on 06.01.2009 and ultimately, he sold the property to and in favour of one A.Nazrath Kumar. Now the petitioner intends to purchase the subject property from the said A.Nazrath Kumar by virtue of sale deed dated 19.08.2025. However, the respondent refused to register the same. Hence, the Writ Petition.

The learned Special Government Pleader appearing for the respondent would submit that the main reason for issuance of impugned refusal check slip was that, initially, for S.No.51/23, situated at Vilangudi bit 1, to the extent of 0.1.78 ares, patta was issued in the name of one Meenakshi Ammal in Patta No.10920.

4. In reply, the learned counsel appearing for the petitioner would submit that the subject property is situated at S.No.63/1A1C, Thathaneri Village, Madurai North Taluk and S.No.51/23 has nothing to do with the subject property.

5. After perusal of the impugned refusal check slip, the learned Special Government Pleader also fairly agrees that the survey number mentioned in the check slip and the survey number of the subject property are different. He therefore, prayed for appropriate orders.

6. I have given due consideration to the submissions made on either sides.

7. In the present case, the petitioner's vendor's vendor has purchased the subject property from Tamil Nadu House Board by virtue of sale deed dated 08.12.2008. Thereafter, the petitioner's vendor purchased the same on 28.01.2009. The survey number of the subject property is S.No.63/1A1C, which is situated at Thathaneri Village, Madurai North Taluk. However, in the impugned refusal check slip, a different survey number viz., S.No.51/23, situated at Vilangudi bit 1 has been mentioned. Further, a power of attorney registered in the year 1998 was also mentioned therein. The property mentioned in the impugned refusal check slip has nothing to do with the subject property. Even assuming that there is some connectivity between the subject property and the property referred to in the refusal check slip, since the subject property was acquired by the Tamil Nadu Housing Board in the year 1994 itself, there is no locus standi for the said Meenakshi Ammal to 3/5

execute a power of attorney. Such being the case, with non-application of mind, the impugned check slip was issued and the petitioner, certainly, is entitled for registration of the sale deed dated 19.08.2025.

In view of the same, the impugned check slip dated 19.08.2025 issued by the respondent is set aside and the petitioner is directed to represent the sale deed before the respondent and on such re-presentation, the respondent is directed to register the same forthwith, if it is otherwise in order.
