ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police in pursuance of non-bailable warrant issued on 15.02.2013 for an alleged offence punishable under Section 138 of the Negotiable Instruments Act, in S.T.C.No.
888 of 2012 on the file of the Judicial Magistrate Court, Pudukottai and hence, seeks anticipatory bail 2.The learned counsel for the petitioner submitted that one Gajendran has filed a private complaint alleging that the cheque issued by the petitioner for a sum of 50,000/- is dishonoured and the petitioner is ready to deposit a sum of Rs.25,000/- to the credit of S.T.C.No.888 of 2012 without prejudice to his right.
3.The learned Government Advocate (Crl.side) submitted that the case is pending without any progress due to the non cooperation of the petitioner for the past three years.
4.Considering the submission made by the learned counsel for the petitioner, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions.
5. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Pudukottai and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Court concerned and on further condition that the petitioner shall deposit a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) to the credit of S.T.C.No.888 of 2012 on the file of the learned https://hcservices.ecourts.gov.in/hcservices/
Judicial Magistrate, Pudukottai and he shall appear before the concerned Court for all future hearings without fail. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6.
