(MD).No.1/2015 in AS.(MD).No.205/2015 dated 21.01.2016 and thus render justice.

Prayer in AS(MD)No.205/2015:

To set aside the order passed in the Judgment and decree dated 09.09.2008 in LAOP No.20/2000 on the file of the Sub Court, Paramakkudi and thus render justice.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.R.VELMURUGAN GOVERNMENT ADVOCATE for the petitioner and of MR.S.CHINNAIYAN, Advocate for the Respondent the court made the following order:- The appellant herein has come forward with this application seeking extension of time to comply with the order of this Court dated 21.01.2016 by stating that he filed stay application for staying the judgment and decree passed in L.A.O.P.No.20 of 2009, in which interim stay has been granted on condition to deposit 50% of the award amount in L.A.O.P.No.20 of 2009. He sought for extension of 8 weeks' time. This Court by order dated 19.07.2016 has granted four weeks' time and for compliance, the matter was directed to be posted today.

2. When the matter was taken up for hearing, it is represented that the condition already imposed by this Court

has not been complied with. Hence, this petition is dismissed. The Interim Stay already granted stands vacated. It is left open to the respondent/Claimant to approach the executing Court.
