To call for the records in Special C.C.No.78 of 2014 on the file of the Learned Special Judge for Trial of Cases under the Prevention of Corruption Act, Sivagangai, and Set Aside the judgment dated 30.10.2023 and acquit the Accused / Appellant. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.MAYIL VAHANA RAJENDRAN.C, Advocate for the petitioner and of Mr.A.THIRUVADI KUMAR, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed to relax the condition 1/3

imposed on the petitioner in Crl.M.P.(MD).No.15743 of 2023 in Crl.A.(MD).No.992 of 2023 dated 08.11.2023.

2. The learned counsel for the petitioner would submit that as per the direction of this Court, the petitioner is complying with the conditions regularly from 20.11.2023. He further submitted that the petitioner is aged about 68 years and due to his old age factors, it is difficult for him to comply with the conditions and hence, he pleaded for relaxing the condition imposed on him by the Court. 3.The learned Additional Public Prosecutor appearing for the State would submit that petitioner is complying with the conditions imposed by this Court regularly and hence, the conditions may be modified once in a month.

4. Considering the submissions made on either side, the condition imposed as against the petitioner is modified to the effect that the petitioner shall report before the concerned trial Court, on the first working day of every English Calendar month at 10.30 a.m., until further orders.
