Prayer in WP(MD). 21001/ 2016 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus, directing the respondent to register the sale deed dated 17.06.2016 presented by the petitioner in respect of the property measuring about 0.1.06 acre comprised in Survey No.11/6A, Sukkiranpatty Village, Pattukottai and release the same and pass such further or other order as this Honble Court. For Petitioner :No Appearance For Respondent-1 :No Appearance For Respondent-2 :Mr.K.Guhan

O R D E R

The Review Applicant/Petitioner has preferred the instant Review Application as against the order passed by this Court in W.P. (MD) No.21001 of 2016 dated 04.04.2018.

2. The matter was earlier listed on two occasions viz., 22.03.2019 & 29.04.2019 and heard through video conferencing and the same came to be adjourned at the request of the counsels. Today, when the matter was called, the learned counsel representing on behalf of the petitioner seeks further time. It is seen that the Writ Petition came to be rejected on the ground that the prayer sought for in the Writ Petition cannot be granted, since it would https://hcservices.ecourts.gov.in/hcservices/

give raise to third party interest and also in view of the pendency of the civil suit for specific performance. The ground raised in the present Review Application is on the merits of the order passed in the Writ Petition. If at all, the petitioner is aggrieved, it is always open to him to file an appeal against the order passed by this Court as reviewing the order cannot be sought for. Hence, I do not find any merits in the Review Petition. Accordingly, the Review Application stands closed. However, there shall be no orders as to costs.
