Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.2, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 408 and 420 of I.P.C., in C.C.No.423 of 2012 on the file of the Judicial Magistrate, Nilakottai, Dindigul District, seeks anticipatory bail.
2. The learned counsel for the petitioner submitted that the case was registered based on the direction issued by this Court in Crl.O.P.(MD) No.8945 of 2011 and the petitioner was not aware of the registration of the case and the case was taken on file in C.C.No.423 of 2012. It is further submitted that summon was issued and the same was not served on him and he case to know about the case only recently.
3. Heard the learned Government Advocate (Crl.side).
4. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of his arrest or on his appearance before the learned Judicial Magistrate, Nilakottai and on his executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the trial Court for all future hearing dates without fail.
