(Made by R.VIJAYAKUMAR,J.) The present Review Application has been filed by the appellant in W.A(MD).No.380 of 2022 seeking to review the order dated 08.12.2022. 2.The writ petition was filed by a Police Constable challenging the punishment imposed upon him by postponement of increment of one year without cumulative effect due to the accident committed by him while driving the Police Van. The Writ Court by its order dated 17.03.2022 had confirmed the punishment but directed the authorities to regularize the suspension period. This order was challenged in W.A(MD)No.380 of 2022. This Court was pleased to confirm the order of the writ Court on the ground that the Appellate Authority had dismissed the appeal on the ground of limitation but the Revisional Authority has gone into the merits of the case and reduced the punishment. 2/5
However, the writ Court has considered the entire case on its merits and had confirmed the order of punishment.
3.The present Review Petition has been filed reiterating all the grounds that were mentioned in the writ petition as well as in the writ appeal. The grounds do not disclose any error apparent on the face of the record. The grounds of review and the submissions made by the learned counsel for the review petitioner would clearly disclose that an attempt is being made to reargue of the writ appeal.
4.We are of the considered opinion that the grounds raised in the Review Application do not fall under the purview of Order 47 Rule 1 C.P.C. We find no merit in the Review Application and the same is dismissed. No costs. (D.K.K.J.,) (R.V.J.,) 20.03.2023 Index :Yes/No Internet :Yes/No NCC : Yes/No msa 3/5
