Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records of the impugned order passed by the third respondent, dated 07.01.2020 bearing LVB/539/BR/02/2019-20 and quash the same and direct the respondents 1 and 2 to pass necessary orders and thereby enabling the petitioner to get the loan under Entrepreneur Development Programme.

O R D E R

The Writ Petition is directed against the order passed by the third respondent, dated 07.01.2020, rejecting the application of the petitioner on the ground that the project is not liable.

2. When the matter is taken up for hearing today, there is no representation of the second respondent.

3. The learned counsel counsel for the third respondent would submit that in the counter affidavit filed by the second respondent, they have specifically stated that the writ petitioner may submit an application to some other bank, then the second respondent is ready to recommend the petitioner's application for further more action on behalf of his request and the same would be forwarded to other bank as well as 2/4

TAHDCO, he is ready to issue subsidy amount to the petitioner account without any delay.

4. The learned counsel for the petitioner would submit that in view of the specific submission made by the second respondent, the petitioner is ready to submit fresh application and the second respondent may be directed to forward the same.

5. Recording the submissions made by the learned counsel on either side, the petitioner is at liberty to give fresh application to the second respondent and on receipt of the same, the second respondent is directed to act in accordance with law, within a period of four weeks from the date of receipt of application.

6. With the above direction, this Writ Petition is disposed of. Consequently, connected Miscellaneous Petitions are closed. No costs. 10.04.2024 NCC :Yes/No Index :Yes/No Internet : Yes/ No das 3/4
