PRAYER: Petition is filed under Section 482 of the Criminal Procedure Code, to call for the records pertaining to the Crime No.36 of 2013 under Sections 406, 420 and 506(i) of I.P.C., pending on the file of the second respondent police and quash the same.

This Criminal Original Petition has been filed by the accused No.1 to quash the F.I.R., in Crime No.36 of 2013 for the offences punishable under Sections 406, 420 and 506 (i) of I.P.C on the file of the second respondent police.

2.Heard, Mr.R.Aravind Raj, the learned counsel appearing for the petitioner, Mr.A.P.G.Ohm Chairma Prabhu, learned Government Advocate (Crl.side) appearing for the first and second respondent and Mr.S.M.S.Johny Basha, learned counsel appearing for the third respondent.

3.The learned Government Advocate(Crl.side) appearing for the first and second respondents has submitted that during pendency of the present petition charge sheet has been filed and the case has been taken on file in C.C.No.44 of 2014 on the file of the learned Judicial Magistrate No.II, Ramanathapuram. The accused were acquitted on 18.06.2014.

4.Recording the aforesaid submissions, this Criminal Original Petition is dismissed as infructuous. Consequently, connected MP (MD)No.1 of 2014, is closed.
