For Respondent : Mr.M.Chandra Sekaran, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Section 438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.164 of 2015 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, who is arrayed as A9, apprehending arrest at the hands of the respondent Police for the offence under Sections 147, 294(b), 323 and 506(ii) of IPC and Section 4 of Tamilnadu Women Harassment Act, 2002, in Crime No.164 of 2015 on the file of the respondent Police, seeks anticipatory bail.

2.The learned Government Advocate (Criminal Side) appearing for the respondent Police submitted that the investigation has been completed and absconding charge sheet has been filed by the respondent Police and the same has been taken on file in C.C.No.98 of 2016 before the Judicial Magistrate, Vilathikulam. He further submitted that on 19.01.2021, the petitioner filed a petition under Section 317 Cr.P.C., which was accepted by the Judicial Magistrate, Vilathikulam. He further submitted that the trial court has posted the case for hearing on 12.02.2021.

CRL OP(MD). No.1456 of 2021 3.Considering the submission made by the learned Government Advocate (Criminal Side) that in this case absconding charge sheet has been filed and thereafter, the petitioner already appeared before the trial Court through his counsel and filed petition under Section 317 Cr.P.C., and the same has been allowed by the trial Court on 19.01.2021, in view of the same, the trial Court is directed to accept the bond under Section 88 Cr.P.C. Further, the petitioner is directed to appear before trial Court on 12.02.2021. 4.With the above direction, this criminal original petition stands disposed of.
