ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused 1 and 2 in Crime No.553 of 2015 on the file of the respondent police apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 342, 324 and 506(ii) of I.P.C. and hence, seek anticipatory bail.
2.The case of the prosecution is that the petitioners and other accused persons commented about the de-facto complainant's girl friend in facebook and when questioned about the same, the petitioners and four other accused have attacked the de-facto complainant. 3.The learned counsel for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case. It is submitted that the petitioners herein are young students, whose life should not be put into jeopardy especially when the complaint lodged against them based on unfounded suspicion. 4.The learned Government Advocate (Crl. Side) would submit that the injured has already been discharged from the hospital and the prosecution has no objection for granting anticipatory bail. 5.
Considering the stated circumstances, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.II, Tuticorin and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent https://hcservices.ecourts.gov.
