For Respondent : Mr.R.Suresh Kumar Government Advocate PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail Crime No.34 of 2021 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/Accused No.1, apprehending arrest at the hands of the respondent police for the offences punishable under Sections 498(A) of I.P.C., in Crime No.34 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case against the petitioner is that the petitioner and the defacto complainant belonged to different community and there is some family dispute between them. The petitioner is the husband of the defacto complainant.

3.On the side of the petitioner, it is stated that there is some family dispute. Already a similar complaint was filed by the defacto complainant before the All Women Police Station, Sankarankoil and the matter was compromised at that stage. Again, the defacto complainant has filed this complaint. The couple has a girl baby. The petitioner is ready for compromise and prayed the petitioner to be released on anticipatory bail. 4.On the side of the respondent, it is stated that the petitioner/ A1 is the husband and he married the defacto complainant. Though it is a love marriage, there was a demand of dowry and that the petitioner attacked the defacto complainant and he prayed the petition to be dismissed.

5.Considering the submissions made by both the parties, this Court is inclined to refer the matter to the Mediation Centre for settlement. The mediation efforts failed, since the respondent was absent.

6.Considering the submissions made by both parties and considering the facts and circumstances of this case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

7.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or his appearance, before the learned Additional Mahila Court, at Magisterial level, Madurai district, and on his executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioner shall appear before the respondent police daily at 10.30 am for a period of one month and thereafter, as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 of Cr.P.C., scrupulously.

8.The petitioner shall appear before the concerned Magistrate within a period of fifteen days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
