This Criminal Original Petition has been filed to quash the final report in C.C.No.312 of 2018, on the file of the learned Judicial Magistrate No.II, Tuticorin, filed for the offences under Sections 509, 506(ii), 294(b) IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act.

2. The allegation against the petitioner is that by using his cell phone without making any call to anyone as if he is talking with some person in phone abused the defacto complainant by using obscene words.

4. In view of the above, this Court is not inclined to quash the proceedings. Accordingly, this Criminal Original Petition is dismissed and the personal appearance of the petitioner is dispensed with before the trial Court except for receiving the copies, answering the charges, questioning under Section 313 Cr.P.C., and any other date that may be required by the trial Court.
