ORDER

The present Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondent not to interfere with the petitioner in putting up iron fencing around his residential property, based on the survey report and survey sketch.

2. The learned counsel appearing for the petitioner submitted that the property belongs to him. However, the learned counsel appearing for the respondent disputed the same and submitted there are several litigations pending between the parties.

3. It is brought to the notice of this Court that the petitioner had earlier filed W.P.(MD) No.25002 of 2022, which was disposed of by order dated 24.07.2023. Subsequently, the petitioner filed another writ petition in W.P.(MD) No.12084 of 2024, which was disposed of by order 2/4

dated 10.06.2024, wherein the learned Single Judge declined the petitioner's request to put up fencing around the property.

4. When the petitioner has already suffered an adverse order in W.P.(MD) No.12084 of 2024 in respect of the very same relief, the present Writ Petition seeking an identical prayer is not maintainable. The present petition is clearly barred by the principles of res judicata.

5. For the reasons stated supra, this Writ Petition stands dismissed. There shall be no order as to costs.
