ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 341, 302 and 506(ii) IPC, in Crime No.469 of 2014 on the file of the respondent police, seeks anticipatory bail.
2. This is an application for anticipatory bail, which was filed as early as on 26.08.2014 and has been pending on the file of this Court since then. On 31.03.2015, the Criminal Original Petition was taken up for hearing and adjourned to today, finally. Today, when the petition is taken up for hearing, there is no representation for the petitioner and therefore, this Court perused the case diary produced by the police.
3. The case of the prosecution is that the deceased, in this case, is one Baskaran. He and his wife - Vijaya Jothi, the de facto complainant in this case, were returning home on 11.08.2014 by a two wheeler and they were intercepted by this petitioner and others, around 07.00 PM and the husband of the de facto complainant was indiscriminately attacked and done to death. Based on the complaint lodged by the wife of the deceased, this case has been registered. Even in the First Information Report, the name of this petitioner https://hcservices.ecourts.gov.in/hcservices/
has been mentioned and his overt acts have also been given in detail.
4. In view of the serious nature of allegation against this petitioner, this Court is of the view that this is not a fit case to grant anticipatory bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
