ORDER : The Court Made the following order :- The petitioner is in judicial custody from 16.07.2015 in respect of the alleged offence under Section 366-A IPC, in Crime No.196 of 2015 on the file of the respondent police and he has come forward with this petition seeking bail.

2. Heard both sides.

3.Even though, it is alleged that the accused kidnapped the victim girl, whether really the girl is the victim is the question raised in this application. It is represented that the girl was major at the time of incident and it is a case of elopping and not kidnapping.

4.It is the case of the learned counsel for the petitioner that the accused had married the victim girl and both the victim and the accused are living together as husband and wife. This fact is not disputed by the prosecution.

5.Considering the age of the victim and considering the status of parties as on today, this Court is inclined to grant bail to the petitioner subject to the condition that the petitioner shall execute https://hcservices.ecourts.gov.in/hcservices/ a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two

sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Natham.
