C-24B. For Bail in Crime No.141 of 2025 on the file of the Respondent Police. ORDER: The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 04.12.2025 for the offences punishable under Section 318(4) of the BNS and Section 66 D of Information Technology (Amendment) Act, 2008 in Crime No. 141 of 2025, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that one Madan Kumar contacted the defacto complainant and said that the defacto complainant was involved in human trafficking and he showed the order of the Hon'ble Supreme Court to freeze the

properties of the defacto complainant. The above said person colluded with others persons and tuned Rs.30,00,000/- from the defacto complainant and Rs.10,00,000/- was deposited in the petitioner's bank account. Hence, this case.

3. The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, he has been arrested and he is languishing in jail from 04.12.2025. Therefore, he prays for grant of bail.

4. The learned Government Advocate (Crl.side) appearing for the respondent police opposed for grant of bail on the ground that the investigation is still pending. Further, Rs.7,00,000/- was recovered from the petitioner. 5.Considering the facts and circumstances and considering the period of incarceration, this Court is inclined to grant bail to the petitioner on certain conditions.

Accordingly, the petitioner is ordered to be released on bail, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two blood sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.1, Madurai, and on further conditions that, a)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity;

b) the petitioner is directed to deposit a sum of Rs.3,00,000/- (Rupees Three Lakh Only), in three equal installments to the credit of Crime No. 141 of 2025 before the learned Judicial Magistrate No.I, Madurai. The 1st installment of Rs. 1 lakh/- shall be deposited while producing sureties, the 2nd installment of Rs.1 lakh/- shall be deposited on or before 28.02.2026 and the 3rd installment of Rs.1 lakh/- shall be deposited on or before 28.03.2026. After receipt of entire amount, the learned Judicial Magistrate, shall deposit the said amount in an interest bearing Fixed Deposit in any Nationalized Bank initially for a period of one year and renew them periodically until the final order/Judgment is passed in the case in Crime No.141 of 2025. The learned Judicial Magistrate or Trial Court shall pass orders regarding entitlement of the said amount in its final order/Judgment.

c)the petitioner shall report before the respondent police daily at 10.30 a.m., for two weeks and thereafter, as and when required for interrogation, until further orders; d)the petitioner shall not tamper with evidence or witness; e)the petitioner shall not abscond during trial; f)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with

law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]. g) If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
