ORDER

Seeking to direct the respondent police to register the F.I.R and to complete the investigation pursuant to the order passed in Crl.M.P.No. 2023 of 2025, dated 18.07.2025 on the file of the Judicial Magistrate, Peravurani, Thanjavur District, this criminal original petition is filed.

The learned counsel for the petitioner submitted that the petitioner had already filed an application under Sections 173(4) and 175(3) of BNSS before the learned Judicial Magistrate, Peravurani, Thanjavur District, which was allowed directing the respondent police to conclude the investigation as expeditiously as possible within a period of 20 days from the date of the order passed by the trial Court. However, even after the lapse of more than five months, there is no progress in the investigation. Hence, this petition.

3. The learned Government Advocate (Crl.Side) submitted that an enquiry has been conducted by the 2nd respondent police and a report 2/5

has already been filed before the learned Judicial Magistrate stating that one of the accused is employed abroad and necessary steps have been duly taken through the Passport Officer concerned. However, the investigation regarding whether one Gomathi, proposed accused was in India or abroad at the time of occurrence is still pending, as an inquiry is yet to be initiated with the concerned Passport Officer in this regard.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the submissions made on either side, this Court directs the respondent to forthwith comply the order passed in Crl.M.P.No.2023 of 2025, dated 18.07.2025 on the file of the Judicial Magistrate, Peravurani, Thanjavur District and conclude the investigation as expeditiously as possible within a period of two (2) weeks from the date of receipt of copy of this order. 3/5

6. With the above directions, this Criminal Original Petition stands disposed of.
