ORDER

This writ petition has been filed for the following relief : "forbearing the 1st respondent from passing any order to transfer the electricity connection bearing No. 006015508T pertaining to property comprised in No.31, Loordhunagar 7th street, K.Pudur, Madurai, Standing in the name of the petitioner unless the title of the petitioner is decided by the competent civil court by way of any adverse order."

2. The petitioner would submit that he is the owner of the subject property. He has purchased the said property from the 2nd respondent through her power of attorney vide registered sale deed dated 18.08.2002. Since then, he has been in continuous possession and enjoyment of the property. All the revenue records including tax registry and electricity service connection stand in his name. The 1st respondent has also ordered transfer of the electricity connection to his name with effect from 12.12.2022.

The petitioner would further submit that this Court, in its order dated 23.06.2022 in W.P(MD)No.7734 of 2014, confirmed his right and directed that the tax registry be maintained in his name until the civil dispute in O.S.No.177 of 2004 is finally decided. As of now, no suit is pending except a restoration petition. However, he came to learn that the 2nd respondent has sought re-transfer of the electricity connection to her name without any legal basis and the 1st respondent appears to be preparing to act on that request without following due procedure. Therefore, the petitioner is before this Court.

4. Heard the learned counsels on either side.

Considering the order passed in W.P(MD)No.7734 of 2014 wherein this Court has confirmed the petitioner's right to the property till final orders are passed in the suit, the request of the 2nd respondent for retransfer electricity connection in her name can be disposed of only after hearing the objections of the petitioner herein.

6. The Writ Petition is therefore disposed of with the above direction.
