The petitioner herein challenges the impugned communication dated 24.12.2019 issued by the fifth respondent. The said communication reads that already Form-I to form-III notices have been issued. It is beyond dispute that survey No.1/1 in Velivayal Village has been classified as water body. The petitioner not only challenged the said communication but also wants patta for the same.
3. It is well settled that in respect of the water body, patta cannot be issued. This writ petition was filed in the year 2020. We are now in June 2025.
4. When the matter was taken up for final disposal, the learned Additional Government Pleader submitted that the petition-mentioned encroachment has already been removed. In fact when the matter was taken up for admission on 31.01.2020, all that the petitioner prayed was that since paddy crops planted by him were ripe for harvest, he wanted time till 09.02.2020 to vacate and hand over the possession to the respondents after completion of the 3/6
4 W.P.(MD)NO.1980 OF 2020 harvest. The petitioner has no legal right as such. This writ petition stands dismissed. No costs.
