2 forthwith Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.ALAGUMANI.R, Advocate for the petitioner and of Mr.B.THANGA ARAVINDH, Government Advocate (Crl. side) on behalf of the Respondent No.1 and of Mr.K.MANOHARAN, Advocate for the Respondent No.2, the court made the following order:- This Criminal Miscellaneous Petition has been filed to cancel the bail granted by this Court in Crl.O.P(MD)No.21986 of 2022, dated 13.12.2022 to the second respondent/sole accused. 2.Heard the learned counsel on either side.
3.It is seen that this Court had granted bail to the second respondent/sole accused herein on the ground that the victim girl had already fell in love with the second respondent/sole accused and eloped with him and also performed marriage. Therefore, the case was registered under the POCSO Act and also under the Prohibition of Child Marriage Act. This Court, on perusal of statement recorded https://www.mhc.tn.gov.in/judis 1/2
CRL MP(MD) No.1443 of 2023 from the victim girl under Section 164 of Cr.P.C. that the petitioner is being the father of the victim girl, misbehaved with her and as such, his contact is very bad, had granted bail to the second respondent. Now, the petitioner again filed this petition for cancelling the bail granted to the second respondent. Therefore, this Court finds no merits to cancel the bail granted to the second respondent.
4.In the result, this Criminal Miscellaneous Petition is dismissed.
