ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 189, 448, 294(b), 353, 500 and 504 I.P.C. in Crime No.32 of 2019 and seeks anticipatory bail.

2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. side) appearing for the respondent.

3.The allegation against the petitioner in the First Information Report registered in Crime No.32 of 2019 is that he threw his weight as a MLA on the Government Boys Higher Secondary School, Kothamangalam as well as the Government Girls Higher Secondary School and compelled the Headmaster of the Schools that he would distribute the free cycles to the students as per the welfare scheme of the Government, and he has said to have done it more than once, snatched the keys of the cycle and posed for photographs and caused distribution of the cycles. A complaint was preferred by the Chief Educational Officer.

https://hcservices.ecourts.gov.in/hcservices/ 4.The learned Government Advocate (Crl. Side) submitted that the petitioner threw his weight as a Member of the Legislative

Assembly and interfered with the official duty of the Headmaster, who alone has been authorized by the Government to distribute the cycles to the students.

5.Taking into consideration, the nature of the offences and the broader allegations made therein, this Court grants anticipatory bail to the petitioner on following conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Judicial Magistrate, Alangudi and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on another condition that he shall give an affidavit of undertaking that he shall not interfere with the official responsibilities assigned by the Government to its employees and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
