ORDER : The Court Made the following order :- The petitioner/Sole Accused, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 309, 506(i) I.P.C., and Section 4 of Tamil Nadu Prohibition of Harassment of Woman Act, 2002 and the same was altered into Sections 294(b), 506(i), 306 r/w 511 I.P.C., and Section 4 of Tamil Nadu Prohibition of Harassment of Woman Act, 2002, in Crime No.69 of 2018, seeks anticipatory bail. 2.The case of the prosecution is that on 17.02.2018 at about 5.30 p.m the petitioner demanded the victim to pay a sum of Rs.2000/- for the purpose of consuming liquor. Since the victim refused to pay the said amount, the petitioner abused her by using filthy language. Hence, a case has been registered for the above said offences.
3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person, he has been falsely implicated in this case, he has not committed any offence as alleged by the prosecution. Hence, he prays for anticipatory bail. https://hcservices.ecourts.gov.in/hcservices/
4.The learned Government Advocate (Crl.side) appearing for the State submitted that investigation is still pending. 5.The submissions made by the learned counsel appearing on either side are considered. It is alleged, on 17.02.2018 at about 5.30 p.m the petitioner demanded the victim to pay a sum of Rs.2000/- for the purpose of consuming liquor. Since the victim refused to pay the said amount, the petitioner abused her by using filthy language, thereby, the victim attempted to commit suicide. On perusal of F.I.R., it shows that the petitioner being the third party committed this offence without any reason. So, the offence committed by the petitioner is nothing but grievous one. Therefore, considering the gravity of offence committed by the petitioner, this Court is not inclined to grant anticipatory to the petitioner.
