ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1 in Crime No.215 of 2014 on the file of the respondent police, was arrested on 15.11.2015 for the alleged offences punishable under Sections 8(c) r/w. Section 20 (b)(ii)(c), 29(1) and 25 of NDPS Act and hence, seeks bail.

2. The case of the prosecution is that the accused was found in possession of 250 kgs. of ganja.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case and the co-accused viz., A2 was already granted bail by this Court in Crl.O.P.(MD).No.8209 of 2015 dated 29.04.2015.

4. The learned Government Advocate (Crl.side) vehemently opposed the granting of bail to the petitioner and also filed a counter affidavit. It is further submitted that the petitioner is not having any previous case.

5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. https://hcservices.ecourts.gov.in/hcservices/ Accordingly, the petitioner is ordered to be released on bail on his

executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Additional Principal District Sessions Judge, (NDPS Act Cases), Madurai and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m. until further orders. sd/- 25/09/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
