PRAYER IN CMA(MD).SR.43942 of 2015: This appeal filed under Section 173 of Motor Vehicle Act 1988, praying that this Hon'ble Court may be pleased to prefer this Memorandum of Grounds of Civil Miscellaneous Appeal against the Judgment and award made in MCOP.No.540/2013 dated 09.02.2015 on the file of the learned Special Sub Court, Madurai for the enhancement of the award amount. ORDER : This Civil Miscellaneous petition coming on for hearing on this day and upon perusing the petition and the affidavit filed in support thereof and the petitioner not appeared in person or through Advocate and this court made the following order:- This petition has been filed to condone the delay of 183 days in re-presenting the appeal.

2.When the matter was called on 19.07.2016, there was no representation for the petitioner and hence, the matter was directed to be posted under the caption 'for dismissal'. Even today, there is no representation for the petitioner. Therefore, this petition is dismissed for non-prosecution.
