ORDER

This Criminal Original Petition has been filed to direct the second respondent not to harass the petitioner and her family members under the guise of enquiry.

2.The learned counsel appearing for the petitioner has submitted that the second respondent has initiated proceedings under Section 110 Cr.P.C., against the petitioner's son namely Ranjith @ Ranjithkumar and one criminal case also pending on the file of the second respondent and that being so, the second respondent is harassing the petitioner and her family members to produce the said Ranjith @ Ranjithkumar. He further submitted that whereabouts of the said Ranjith @ Ranjithkumar is not known to the petitioner, but the second respondent is not believing the petitioner's words, he is continuously harassing the petitioner.

3.The learned Government Advocate (Crl.side) has submitted that one case was pending before the learned Judicial Magistrate No.IV, Madurai in PRC.No.1010 of 2006, in which, the said Ranjith @ https://hcservices.ecourts.gov.in/hcservices/

Ranjithkumar is accused no.1 and since, he has not appeared, NBW has been issued against him and only for executing the said NBW, the petitioner was enquired, but the petitioner has filed this petition stating that she has been subjected to harassment. 4.Considering the aforesaid submissions, if NBW is pending against the petitioner's son, it is open to the second respondent to executing the said warrant, but under the guise of enquiry the petitioner should not be subjected to harassment. 5.With the aforesaid observations, this Criminal Original Petition is disposed of.
