O R D E R

The Criminal Original Petition has been filed to direct the learned Judicial Magistrate, (FTC), Thoothukudi to pass order on the recall petition for Non-Bailable Warrant by the petitioner on the same day of surrender in C.C.No.60 of 2013, on the file of the learned Judicial Magistrate, (FTC), Thoothukudi.

2. When the matter was posted for admission, there was no representation on behalf of the petitioner. Even therafter, the learned counsel for the petitioner has not taken any steps to list the matter for admission. The matter is pending for more than 4-1/2 years, without admitting and without directing the notice.

3. It clearly shows that the petitioner has no interest to proceed with the case. At this stage, this Court is not inclined to entertain this petition. Hence, this Criminal Original Petition is dismissed.
