Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners who are apprehending arrest at the hands of the respondent police for the alleged offence under Section 306 IPC in Cr.No.29 of 2019, on the file of the respondent police, seek anticipatory bail.
2.It is the case of the prosecution that the defacto complainant is husband of the deceased. The petitioners and the defacto complainant are relatives. The petitioners obtained amount from the deceased and failed to repay the same. Due to which, the deceased consumed poison and she was died. Hence, the complaint. 3.The learned counsel appearing for the petitioners would submit that the petitioners did not commit any offence as alleged by the prosecution and they are innocent persons. 4.The learned Government Advocate(Crl.side) appearing for respondent police would vehemently oppose for granting of anticipatory bail and would submit that the deceased wrote a suicide note, which was clearly shows that the petitioners borrowed a sum of Rs.27,00,000/- and failed to repay the same and that they are the reason for her death and hence, he would pray for dismissal of this petition.

5.Considering the facts and circumstances of the case and considering the gravity of offence, this Court is not inclined to grant anticipatory bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
