ORDER

This writ petition has been filed challenging the impugned order passed by the respondent in his proceedings C.No.49390/V2/194/2020 dated 07.12.2020 and to quash the same.

2. Heard the learned counsel for the petitioner, and the learned Government Advocate (crl.side) appearing for respondent. Perused the materials available on record.

3. The learned counsel for the petitioner submitted that the impugned order is a one-line order, it is non-speaking, and hence liable to be set aside.

4. On a perusal of the impugned order, it is seen that the explanation afforded by the petitioner has been rejected on a single line that 'it does not up to satisfaction'. Therefore, the same is set aside. The writ petition is allowed, and the matter is remitted back to the respondent. The respondent is directed to pass a fresh order after giving personal hearing to the petitioner, within a period of one month from the date of receipt of a copy of this order. No costs.
