PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of MANDAMUS to direct the respondents No.1 and 6 to consider the petitioner's representation dated 13.06.2025 given to remove the illegal encroachment/road formed in the petitioner's Patta land comprised in Survey No.66/2 to an extent of 0.26.50 Ares situated in Sirukadavakkottai Village, Avudayarkoil Taluk, Pudukkottai District and direct the respondents to restore the land to its original agricultural state within the period that may be stipulated by this Court.

ORDER

The present writ petition has been filed seeking a mandamus directing the respondents herein to remove the road which has been illegally put up in the petitioner's patta land in S.No.66/2 to an extent of 0.26.50 ares in Sirukadavakkottai Village, Avudayurkoil Taluk, Pudukottai District.

2. The learned Additional Government Pleader appearing for the respondents has received written instructions to the effect that they would conduct a survey and in case if any road passes through the petitioner's patta land, the same will be removed.

3. Recording the said undertaking, a direction is passed to the respondents 4 and 5 to conduct a survey and in case if any road passes through the property of the petitioner, the same shall be removed. The survey shall be conducted in the presence of the petitioner.

4. With the above said observations, this writ petition stands disposed of. No costs.
