To set aside the Judgment and Decree of the Sub Court, Paramakudi dated 20.12.2018 partly reversing the judgment and decree dated 09.12.2013 in O.S.No.82 of 2011 on the file of the District Munsif Court, Paramakudi and to dismiss the suit with cause. ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.H.THAYUMANASWAMY, Advocate for the petitioners and of M/s.ANTO PRINCE, Advocate on behalf of the Respondent, the court made the following order:- This petition has been filed by the petitioner seeking to condone the delay of 362 days in filing the Second Appeal.

2. Heard both sides.

3.The learned counsel for the respondent has objected this petition.

4.The learned counsel for the petitioner has stated reasons for the delay in paragraph No.3.

CMP(MD) No.1044 of 2021 5.Satisfying with the reasons stated in paragraph No. 3 of the affidavit filed in support of the petition and considering the length of delay, this Court is inclined to condone the delay subject to the payment of cost of Rs.1000/- (Rupees one thousand only) to the Legal Services Authority, attached to this Bench, within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically without any further reference to this Court.
