1097 of 2014 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to permit the petitioner to withdraw 50% of the award amount with accrued interest lying in the deposit in the credit of M.C.O.P.No.312 of 2013 on the file of Motor Accident Claims Tribunal (Special District Judge), Trichy, pending disposal of the above Civil Miscellaneous appeal and thus render justice. Prayer in MP(MD). 1/ 2014 in CMA(MD).1097/2014 : To stay all further proceedings in MCOP N:o. 312 of 2013 dated 18.02.2014 on the file of the Motor Accident Claims Tribunal, Special District Court, Tiruchirapalli, pending disposal of the above C.M.A. and thus render justice.

ORDER : These petitions coming on for orders upon perusing the petitions and the affidavits filed in support thereof and upon hearing the arguments of M/S. R.GOVINDARAJ, Advocate for the petitioners in CMP(MD) No.6943/2016 IN CMA(MD) No.1097/2014 and respondents in MP(MD). 1/ 2014 in CMA(MD).1097/2014, and M/S.D.SIVARAMAN, Advocate for respondent in CMP(MD) No.6943/2016 IN CMA(MD) No.1097/2014 and petitioner in MP(MD). 1/ 2014 in CMA(MD). 1097/2014, on behalf of the Respondents the court made the following order:- The petitioners in CMP(MD) No.6943 of 2016/Claimants are permitted to withdraw 50% of their share in the award amount with proportionate interest and costs lying in the credit of M.C.O.P.No.312 of 2013 on the file of Motor Accident Claims Tribunal (Special District Judge), Trichy by filing proper application before the Tribunal.
Interim stay already granted is made absolute. Both petitions are closed.
The Tribunal is directed to deposit the balance award amount in fixed deposit in any one of the nationalised bank, intially for a period of one year, renewable thereafter till the dismissal of the appeal.
