ORDER
The petitioner claims right over a property in Survey No.1191, Plot No.379, situated at Karaikudi Nagar, Sivagangai. Admittedly, even according to the petitioner, this property is of the property of one Vijayathammal, who has purchased the same by way of court auction in the year 1955. The petitioner claims that the said Vijayathammal has sold the property by way of an unregistered sale deed to his father on 09.11.1955. Thereafter, his father died on 30.11.2011.

The petitioner claims that the said Vijayathammal has encumberred the property and therefore, he has already filed a Civil Suit as against the said Vijayathammal and the same is pending in O.S.No.313 of 2021. In these circumstances, the petitioner has filed a complaint to the Superintendent of Police and Vigilance and Anti-Corruption Department that at the instance of the Police Officers from Karaikudi 2/5
North Police Station, he was dispossessed from the property. Since there was no action on the said complaint, he has filed this writ petition seeking a Mandamus to the 3rd respondent to take action based on the petitioner's complaint dated 24.12.2024.
3. The learned Additional Public Prosecutor submits that the complaint of the petitioner was forwarded to the Superintendent of Police. The Superintendent of Police has also conducted an enquiry and found that the allegations made by the petitoner are false. According to him, four persons are claiming right over the property in Survey No.1191 at Karaikudi.
4. The learned Additional Public Prosecutor has also pointed out that the petitioner is a history-sheeted rowdy, having ten cases to his credit.
5. Considering the nature of complaint and the nature of right over the property that the petitioner's father has purchased the property by way of an unregistered sale deed and also considering the fact that the 3/5
petitioner has already filed a Civil Suit as against the said Vijayathammal and the same is pending in O.S.No.313 of 2021, this Court is not inclined to entertain this writ petition.
