P RAYER : Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the 1st respondent to take appropriate action on the petitioner's representation dated 20.07.2021 in order to realise an amount of Rs.2,40,92,000/- from respondents 3 to 9 or to attach their properties so as to settle the same among the depositors of Rich India Marketing.

ORDER
This writ petition has been filed to take appropriate action on the representation submitted by the petitioner in order to realize the amount of Rs.2,40,92,000/- from respondents 3 to 9 herein.
2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3. The petitioner is an accused in CC No.8 of 2011 on the file of the Special Court for TANPID Act Cases, Madurai. The petitioner had entered into an agreement with the respondents 3 to 9 in order to purchase their property and issued cheques. Subsequently, the cheques were bounced and no agreement of sale was acted upon. Now, in order to escape from the clutches, the petitioner submitted a representation to attach the properties belonging to the respondents 3 to 9 herein. On investigation, it was found that the property sold by the respondents 3 to 9 is noway connected with the crime.
4. In view of the above, the representation submitted by the petitioner cannot be considered. This writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition is dismissed. No costs.
