ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 406 and 420 of IPC in Crime No. 1/4

717 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that one Annamalai purchased the car model TATA TIAGO bearing registration No. TN57 BZ9211 through hire purchase for which the Yes Bank has given financial assistance. After purchasing the car, he is not able to continue the due amount so that he decided to sell the car and accordingly, he approached the bank wherein A2 of this case has been working as a recovery agent, who introduced the petitioner herein and to that effect, the petitioner was ready to purchase the car even when hypothecation is in force. The total cost is Rs. 3,00,000/- out of which the petitioner paid 15,000/- to him as advance and made an agreement and thereafter, the petitioner did not give the remaining payment nor returned back the vehicle to him and thereby, the petitioner cheated him. Hence, a case has been registered.

3.This Court has already granted an interim order directing the petitioner to deposit Rs.2,85,000/-.

4.It is reported that the petitioner has not complied with the interim direction.

5. Taking into consideration the fact that the petitioner has not complied with the interim direction of this Court, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

6. Accordingly, this Criminal Original Petition is dismissed. 04/12/2025 TMG TO 1.The Inspector of Police, Town Police Station, Sivagangai.
