O R D E R

This writ petition has been filed challenging the impugned order dated 20.01.2021, passed by the third respondent, rejecting the petitioner's request for notional promotion to the post of Junior Assistant with effect from 01.04.1994.

2. Admittedly, the petitioner had retired from service on 30.04.2020 and only thereafter, he has filed this writ petition seeking for notional promotion as stated supra.

3. The law is well settled by the decision rendered by the Honourable Supreme Court in the case of Government of West Bengal and

others vs. Dr.Amal Satpathi and others, reported in 2024 SCC OnLine SC 3512, wherein it has been held that the retired employees cannot seek for notional promotion. In view of the well settled law, the question of entertaining this writ petition does not arise. Therefore, this writ petition will have to be dismissed.

4. Accordingly, this writ petition is dismissed. No costs. 31.10.2025 NCC :
