Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 336, 324 and 506(ii) IPC in Crime No.64 of 2015 and hence, seeks anticipatory bail.
2.According to the defacto complainant, the accused attacked with a stone and also attempted to attack with arival and caused injury. 3.The learned counsel for the petitioner submitted that the petitioner and the defacto complainant had gone to the ration shop to purchase kerosene and the defacto complainant, who was in an inebriated mood, caused commotion in that area and threatened the sales man to close the ration shop and when that was objected by the general public, he attacked the petitioner and caused injuries. The learned counsel further submitted that it is a case of case and counter and the petitioner has also sustained injuries.
4. The learned Government Advocate(Crl.side) appearing for the State submitted that the injured is still in hospital and taking treatment.
5. However, considering the overt act attributed against the petitioner, I am inclined to enlarge the petitioner on anticipatory bail. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned District Munsifcum- Judicial Magistrate, Thiruppathur, Sivagangai District, and on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall https://hcservices.ecourts.gov.in/hcservices/
appear before the respondent police daily at 10.00 a.m for a period of two weeks and thereafter, as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.
6.
