ORDER

The petitioners are accused in Crime No.370 of 2023 registered on the file of the 1st respondent Police, for the offence under Section 387 IPC. Now, they have moved this petition to quash the FIR in Crime No.370 of 2023 registered against them.

2. Today, when the matter is taken up for hearing, the learned Government Advocate (Crl. Side) submits that the investigation in Crime No.370 of 2023 was completed and the final report has also been filed before the learned Judicial Magistrate, Vadipatti, through e-filing in C202300061 dated 22.12.2023.

3. Since it is reported that the final report has been filed in Crime No. 370 of 2023, without ascertaining the materials relied on by the investigating agency in the final report, this Court is not inclined to proceed with the available FIR. Therefore, this Criminal Original Petition is closed with liberty to the petitioners to challenge the final report, if they are having any ground. Mere filing of the final report through e-filing is not sufficient. The respondent Police shall ensure that the final report is taken on file 2/4

within a reasonable time. It is not only the responsibility of the respondent Police, the trial Court is also expected to take the final report on file, without any delay. Consequently, connected miscellaneous petition is closed.
