RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the affidavit filed therewith the High Court may be pleased to permit the Petitioner/Appellant in the above Second Appeal to get the return of the Documents Ex.B1, Ex.B6 and Ex.B7 marked in O.S.No.208 of 1999 on the file of the District Munsif Court, Thuraiyur by replacing the same with the certified copies of the said Documents.

Prayer in SA(MD) No.888 of 2010:

To prefer the Memorandum of grounds of Second Appeal against the Judgment and Decree dated on 15.07.2009 in A.S.No.208/2008 on the file of learned Subordinate Judge, Trichy, confirming the decree dated 30.11.2007 in O.S.No.208 of 99 on the file of learned District Munsif Thuraiur, Trichy.

ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.M.SIDDHARTHAN, Advocate for the petitioner and of MR.R.SUNDAR, Advocate on behalf of the Respondent, the Court made the following order:- The petitioner / appellant filed a petition for return of original documents viz., Exs. B1, B6 and B7, after substituting the certified copies of the documents.

2. The counsel for the respondent has no serious objection to allow this petition.

3. Considering the facts and circumstances, the petitioner is permitted to substitute the certified copies of Exs.B1, B6 and B7 and get back the original documents.
