(Order of the Court was made by N.SATHISH KUMAR, J.) This Writ Petition has been filed seeking a direction to the respondents 1 and 2 to distribute compensation for the respective farmers as per the available list (Form-1A) with the 2nd respondent, as it is mentioned in his proceedings in Na.Ka.Pe Mae 24(1)/2018 dated 2/10
31.07.19 within a time frame fixed by this Court as per the representation made by this petitioner dated 14.10.2019.

The main grievance of the petitioner claiming to be a member of the association that the State Government has not distributed any relief for all other species of trees like Jack Fruit Tree, Plantain Tree, Casuarinas, Sandal Wood Tree, Teak and Lemon Tree, except the Coconut tree, which were affected by Gaja Cyclone. In this regard, the petitioner has also submitted a representation on 19.07.2019 before the 2nd respondent. However, the same has not been considered by the 2nd respondent. Hence, the petitioner has filed this Writ Petition.

The learned Additional Government Pleader appearing for the respondents by referring to the counter affidavit filed by the 2nd respondent submitted that the entire compensation amount were distributed to the farmers and residents, who were affected by Gaja Cyclone. Paragraph No.7 of the counter affidavit reads as follows: "7. I respectfully submit that, In G.O.(Ms). No.380 dated 27.10.2015, in the revised list of items and norms of assistance from State Disaster Response Fund (SDRF) and National Disaster Response Fund (NDRF) were notified as follows:- 3/10

No Items Norms of Assistance GRATUITOUS RELIEF (a) Ex-gratia payment to families of deceased persons Rs. 4.00 lakh per deceased person including those involved in relief operations or associated in preparedness activities, subject to certification regarding cause of death from appropriate authority.
(b) Ex-gratia payment for loss of a limb or eye(s) (i) Rs. 59,100/- per person, when the disability is between 40% and 60%.
(ii) Rs. 2.00 lakh per person when the disability is more than 60% Subject to certification by a doctor from a hospital or dispensary of Government, regarding extent and cause of disability.
(c) Grievous injury requiring hospitalization (i) Rs.12,700/- per person requiring hospitalization more than a week (ii) Rs.4,300/- per person requiring hospitalization for less than a week (d) Clothing and utensils /household goods for families whose houses have been washed away / fully damaged /severely inundated for more than two days due to a Natural Calamity Rs. 1800/- per family for loss of clothing Rs. 2000/- per family for loss of utensils / household goods.
(e) Gratuitous Relief for families whose livelihood is seriously affected Rs. 60/- per adult and Rs. 45/- per child, not housed in relief camps. The Tahsildar shall verify and prepare a list of those affected and identify the beneficiaries.
Input subsidy (where crop loss is 33% and above) (a) For agriculture crops, horticulture crops and annual plantation crops Rs. 7410/- per hectare for crops other than paddy in rainfed areas and restricted to sown areas.
Rs. 13,500/- per hectare for crops in assured irrigated areas, subject to minimum assistance not less than Rs. 1000 and restricted to sown areas (b) Perennial crops Rs. 18,000/- per hectare for all types of perennial crops subject to minimum assistance not less than Rs. 2000/- and restricted to sown areas, (c) Sericulture Rs. 7410/- per hectare for Eri, Malberry, Tussar. Rs. 6000/- per hectare for Muga.
(d) Paddy Rs. 13,500/- per hectare subject to minimum assistance not less than Rs.1000 and restricted to sown areas.

AGRICULTURE Assistance to farmers Rs.12,200/- per hectare A) Assistance for land and other loss A ) Desilting agricultural land of b) removal of debris on agricultural land in hilly areas c) De-silting Restoration / Repair of fish farms Rs. 37,500/- per hectare whose ownership of the land is legitimate as per the revenue records. d) Loss of substantial portion of land caused by landslide avalanche change of course of rivers As per the above guidelines, a proper inquiry and field visit were carried out by the Tahsildars, agriculture and Horticulture officers in the affected areas to evaluate the damages and devastations caused by the Gaja Cyclone on an individual basis. Subsequently, the relief fund and compensation packages were distributed to the affected farmers based on the above guidelines as per G.O. Hence I deny the petitioner's averments, which contain no proper knowledge of facts
8. I humbly submit that the G.O. (Ms). No.458 dated 20.11.2018 categorically stipulates that, "para 3. Based on the announcement of the Hon'ble Chief Minister in the Press Statement dated 19.11.2018 and the proposal of the Additional Chief Secretary/Commissioner of Revenue Administration, the Government accord sanction for 5/10
a sum of Rs. 1000.00 crore (Rupees Thousand crore only) from State Disaster Response Fund (SDRF) to the District Collectors and Line Departments for carrying out the relief and restoration measures in the affected Districts as detailed below:- Para 5. The amount sanctioned in paragraph 3 above shall be debited to the following heads of account:-

Assistance for Crop Loss:- "2245 Relief on account of Natural Calamities -02-Floods Cyclones etc., 114-Assistance to Farmers for purchase of Agricultural inputs - State's Expenditure -Subsidy to Small and Marginal Farmers for Agricultural Inputs due to Flood - 11 Subsidies 01 - Individual based subsidy."
(b) Assistance for Crop Loss:- "2245 Relief on Account of Natural Calamities 02. Flood, Cyclones etc 800 Other Expenditure- State's Expenditure - BH Relief measures to farmers due to damage of Horticulture Crops in Flood affected areas 11 subsidies-01 Individual Based Subsidy".

the Chief Minister relief had been distributed as follows I humble furnish the details of relief disbursed crop wise to farmers below:

We have also seen that the affidavit is completely bereft of any details and makes no mention of the affected farmers or the number of trees, etc. Therefore, due to the generic nature of the allegations, the petitioner, as a matter of right, cannot now canvass the case of the socalled affected persons. Admittedly, no complaint has been made by anyone regarding this matter. In the absence of specific details and based solely on general allegations, no direction can be issued in this Writ Petition as prayed for. Hence, this Court does not find any merit in the Writ Petition.

5. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
