PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the learned District Munsif Cum Judicical Magistrate, Kamudhi to expedite the trial pending in C.C.No.115 of 2016 and conclude the same within a time stipulated fixed by this Honourable Court.

ORDER

This petition has been filed seeking direction to expedite the trial in C.C.No.115 of 2016 pending on the file the learned District Munsif Cum Judicical Magistrate, Kamudhi

2. The learned counsel for the petitioner would submit that the petitioner is the complainant and LW 1 in C.C.No.115 of 2016 pending trial for offences under Sections 323,294(b), 341,354,506 (ii) of IPC r/w.Section 4 of TNPHW Act and the first respondent is alone facing a charge under Section 494 of IPC. The evidence of petitioner was taken on 06.09.2019 and thereafter the matter is posted for several hearings and the accused are repeatedly filing petition under Section 317 of Cr.P.C to drag on the case. He would also submit that the petitioner is ready to bring other witnesses and ready to co-operate for trial

Under such circumstances , there shall be a direction to the learned District Munsif Cum Judicical Magistrate, Kamudhi to dispose the case pending in C.C.No.115 of 2016 within a period of four months from the next hearing date and report compliance to this court after completion of the proceedings. https://hcservices.ecourts.gov.in/hcservices/ 1/2
